Within the framework of this website, the user is given the opportunity to access real-time price information for securities tradable on the BWWB. A real-time price is a stock exchange price for a security, between the determination and publication of which there is typically a period of less than 15 minutes. The prerequisite for accessing real-time price information is the complete and truthful registration of the user using the data form provided on the website for this purpose.

 

Real-time price information may only be accessed via the website by private users for exclusively private use and excluding retrieval in an automated form without the retrieval being initiated by a natural person in each individual case. A private user within the meaning of these terms of use is someone who fulfils all of the following requirements:

 

a. the user is a natural person;

 

b. the user is not a credit institution, financial services institution or financial company within the meaning of Section 1 of the German Banking Act;

 

c. the user is not subject to any domestic or foreign financial services, banking, stock exchange, securities trading or investment supervision or any other restriction;

 

d. when accessing the real-time price information, the user is not acting for a credit institution, a financial services institution or a financial company within the meaning of Section 1 of the German Banking Act or a company that is subject to domestic or foreign financial services, banking, stock exchange, securities trading or investment supervision or any other restriction;

 

e. the user uses the information exclusively for their personal purposes;

 

f. the user does not use the information for commercial purposes such as commercial securities trading or the commercial management of third-party assets;

 

g. the user also does not use the information in any other way for third-party purposes, such as the gratuitous management of third-party assets within the framework of a non-commercial investment club;

Within the scope of private use, the user is not entitled to use the real-time price information commercially, pass it on to third parties, publish it or sell it. Stuttgart is agreed upon as the exclusive place of jurisdiction for all disputes between Boerse Stuttgart GmbH and the user arising from or in connection with the use of the website. In addition to this German-language version of the General Terms and Conditions, there is an English translation. However, only this German-language version is legally binding, with the exception of No. 3 of these General Terms and Conditions, for which only the English-language version is binding.

 

Notice pursuant to § 36 of the German Consumer Dispute Resolution Act (VSBG)

 

Boerse Stuttgart GmbH will not participate in a dispute resolution procedure before a consumer arbitration board within the meaning of the VSBG and is not obligated to do so.
